Questions clients ask us
Who ends up owning bespoke development work?
By default the developer, which is why it has to be addressed expressly. The contract needs separate treatment for the transfer of economic rights or the scope of use, for source code and documentation, for the right to make derivative works, and for the open source and third-party components the developer builds in.
What should an IT outsourcing contract settle?
Service levels and how they are measured, the escalation path for failures, the processor roles and where data is stored, revocation of system access, and above all the exit scenario: what the customer gets back, in what format and within what period, when the contract ends.
